Is about trademark.?
Actually I am selling clone computer system and recently I was designing brochure, I put a few name for the computer system for example alpha series, sigma series, delta series, just like what dell doing, they put their desktop into several series like dimension, optiplex etc. How can I know whether the name I used is agaisnt somebody's trademark. Because in Malaysia there is one company selling water heater and they put their name Alpha, same to my computer system.
(1) Trademark law is set by the jurisdiction. Many countries, including the United States, grant trademark rights to the first to use a mark for a particular good or service in a particular territory, and have a registration system to grant rights to the entire territory. Other countries grant rights to the first to register a mark.
(2) You can search US Trademark registrations at www.USPTO.gov. However, state trademark registrations and common law marks may also exist, so the search is not exhaustive.
(3) In general, trademarks and service marks apply to specific goods and services, and, absent dilution, the same words or graphics can co-exist as marks for unrelated goods or services.
