Attention Lower And Middle Classes: Don't Be A Victim Of High Attorneys Fees
A certain 60 year old woman has been paying her attorney every month for legal fees accrued four years ago. She was awarded $101 per month for a disability claim, and now the lawyer takes a big percentage of that amount. One lawyer has earned a monthly payment from a disabled miner for the last 10 years. The attorney represented the miner in a case that awarded the miner $134 a month pension payment. As a person looking for workers compensation lawyers you should visit that site.
These cases clearly show how the poor can't afford legal fees. They certainly are not unusual. One claimant, whose husband was bedridden with cancer, was also on welfare. The real problem of legal fees isn't only one that applies to the poor. The middle class suffer from high legal services bills.
One author has said that the middle class is a lawyers? feeding zone now. They have some money and property, but aren't well represented in government. Analyzing the situation would be interesting because, also according to the author, the middle class spawns the majority of our new lawyers.
Lawyer's fees are determined by an hourly rate. One lawyer who concentrates on compensation cases argues that doctors and plumbers are paid on an hourly basis, so why shouldn't attorneys be paid hourly? No one would say the lawyer should not be paid. But, how long is it fair to charge a percentage of the settlement? Lifetime payments from clients are not unusual for divorces, injury suits, will probates and real estate investment. As a person looking for tac claim you should visit that site.
There have been times when a lawyer has stolen large amounts of money from the people that trusted them with their fortunes. In some cases, the lawyers have simply charged insane fees to their clients, instead of taking the money straight up. One partnership charged legal fees over a five year period of up to approximately 60 per cent of one six figure estate. The person to whom the money belonged was unfit to run his own finances, according to the court. Luckily, the attorneys were ordered to repay the estate all the money it had taken in legal fees. The claim was filed by one of the more eccentric attorneys in the region. Other lawyers would have nothing to do with it.
There has been speculation of shady activity which has contributed to the legal fees problem, and it's because of the way the courts are used as a news source. The media won't report the legal fees garnered by guardians and lawyers. This information is readily available from the court. Some of the problem could also be contributed by the bar association itself. They strongly encourage attorney-client privilege and outwardly object to interference by third parties. If anything negative is presented by the media about the legal profession, the associations quickly make a statement to the contrary.
Though attorneys usually charge an hourly rate, some lawyers will only take a payment in the form of a percentage of your future winnings. Plus, the bar associations support attorneys in their insistence of a minimum fee agreement with clients. This is known as a contingent fee. The lawyer will then get a percentage of the award, should the case be won. Twenty-five to fifty percent of the award is the most common fee range for personal injury suits.
Of course, you will mostly only find this fee in America. England, and most of Europe for that matter, won't allow lawyers to collect contingency fees. Around 1848 is when the first contingent fees were put in action, and it was in order to help workers who received on the job injuries. They were only able to file a civil suit using the contingency fee because they didn't have any money.
New bird flu details too dangerous to publish? (KSAT)
A genetically altered strain of the H5N1 avian flu virus is at the center of a
controversial request to keep the details of its creation under wraps.
Scientists in Wisconsin and the Netherlands each created a strain of the
influenza virus that is both highly lethal and easily transmitted between
ferrets. Ferrets are the animals that most closely mimic the human response to
the flu. The Dutch paper, on the transmissibility of H5N1, was to be published
in the journal Science and the University of Wisconsin study was to be
published in the journal Nature. But the National Science Advisory Board for
Biosecurity (NSABB), an independent committee that advises the U.S. Department
of Health and Human Services and other federal agencies on biosecurity matters
reviewed the manuscripts and expressed concern about the release of some of
the data. "We did not think that these papers should be published in the form
that we saw them and that the methods and results should be removed to prevent
someone else from directly replicating their experiments," Dr. Paul Keim, a
microbiologist and chair of NSABB said. "The avian flu is one of the scariest
pathogens that is on ...
